Denny Hoskins: Noun, Verb…CPA?

Oh. My. And I thought Denny Hoskins was having a bad freshman year before the news broke yesterday that he owes over $20,000 in back taxes on properties owned by Hos Properties, LLC, the  rental property business he owns with his brother.

I would imagine it is something of a toss-up which Denny Hoskins regrets more this week...All that yammering he did about being a CPA and how responsible he would be with the taxpayers money, or the slim 122 votes that he won his seat by.

We snagged a screen shot of his website to preserve his touted CPA bona fides

To his credit, he didn't lie and obfuscate when confronted with the information available in the public record.

Rep. Denny Hoskins admitted to The Daily Star-Journal on Wednesday that he failed to pay more than $16,000 in taxes last year.

Hoskins owed the tax bill for the entire 11 months he has served as a House member, with the debt beginning Dec. 31.

Hoskins - who touted being a certified public accountant and who made working to improve the economy cornerstones of his election campaign last year - blamed the failure to pay taxes last year on the recession. He said Hos Properties LLC, a company owned by Hoskins and his brother, owes the taxes.

"It's not something my brother and I are proud of, but our rental property business is struggling just like other, many Missouri businesses, and when our tenants are struggling to pay their rent due to the economic recession, we struggle to pay our mortgage payment and property taxes," Hoskins said.

In addition to owing $16,091 in taxes used to fund local schools and other taxing entities, Hos Properties owes $4,227 in penalties.

Now, beating up on Denny Hoskins is just about my favorite sport outside of World Cup Soccer. I think he's a moron and an embarrassment and has no damned business in the state legislature. But do I think he would be behind in his taxes if the economy didn't suck and people were paying their rent?

Honestly, no. I don't. I feel the same way his opponent does.

The only announced candidate in the race for Hoskins' seat in the 121st District, Courtney Cole, Warrensburg, said she paid all of her taxes.

"Of course I did," Cole said. "They can check all they want."

Cole said she "feels bad for him," but everyone must pay taxes.

"I feel he's doing a disservice to our district by not paying his taxes, especially somebody who's an accountant. It's unfortunate that he doesn't do what's expected of all of the citizens within the district," Cole said.

And they have obviously been trying to collect on monies owed, filing in small claims court to collect on the bad debts their tenants have left them holding. But on the other hand, Warrensburg is a small town, and they got twenty grand in arrears on taxes, so I have to ask...was anyone paying their rent?

On yet another hand, he hasn't let us forget since he announced he was running for the seat, he is a CPA and the code of conduct that he is sworn to mandates he pay all taxes on time, for himself and his clients. And that's pretty immutable.

 Sure the economy has caused problems for many, but I am not willing to feel sorry for Hos Enterprises. They get absolutely no sympathy from me. A CPA who fails to pay taxes is not a CPA at all. Why couldn't he find someone to loan him the money? Why are his property taxes on the list of things that don't need to be paid? Why aren't they included in his mortgage in the first place? I had my own tax problem several years ago, but I am not, nor have I ever claimed, to be a Certiried Public Accountant. As you said his oath requires that he pay his taxes, so now he is a confirmed liar and tax cheat and I am not going to let up on him.

Warrensburg state rep. owes taxes on rental property

....The county will continue to add penalties until the taxes are paid, said County Collector Ruthane Small. If they're not paid within three years, officials will initiate a tax sale.

Small said the county has not seen much of a drop-off in tax collections due to the recession. For 2008, the county had a collection rate of 91 or 92 percent -- "right on schedule," she said.

Rep. Hoskins Responds to Criticism Regarding Property Tax Issue

           JEFFERSON CITY - In response to partisan criticism regarding 2008 property taxes on rental properties, Rep. Denny Hoskins responded with the following statement:

     "Let me be clear: We are not neglecting to pay property taxes on our rental properties. We are, and have been, paying taxes on our rental property business, Hos Properties, LLC, for many years - in fact, our 2008 property taxes will be paid in full by the end of this week. Due to the recession, our business numbers have been unusually low.  Our tenants, mostly students and small families, are living paycheck to paycheck.  When our tenants can't pay their rent, Hos Properties, LLC struggles as well. It's unfortunate that the House Democrat Campaign Committee is trying to make an issue out of our tax payment installation plan at a time when all Missourians are feeling the shockwaves of this serious economic downturn."

     The properties are owned by Rep. Hoskins and his brother, Brian. In response to the comments being issued, Brian explained, "I took over managing the rental properties of Hos Properties, LLC when my brother was elected to office.  In fact, the 2008 property taxes for Hos Properties, LLC will be paid in the full by the end of the week.  This is a time when all Missourians are struggling to make ends meet during a sagging economy and we should be working together and supporting each other, rather than playing petty political games."

"Tax payment installation plan"? How do the rest of us get in on this action?

That didn't sound right.

I called the Johnson County Collector, Ruthane Small, and asked her about the requirements for collecting tax bills. She told me that taxes are due and payable on December 31st. They are delinquent, if not paid, on January 1st. As for any "installation" plan, the tax statements issued by the Johnson County Collector state: "partial payment or proration of tax is not accepted by law." Ruthane Small went on to say that no partial payment for a single property can be accepted, but that full payment for a separate parcel (property) which may constitute a smaller part of the total bill can be paid. As we understand it there were two properties with bills that were much smaller (by comparison) than the two largest parcels. As of my phone conversation with Ruthane Small this afternoon, none of the bills for the parcels have been paid.

And now he's a victim? Uh, didn't the Warrensburg schools lose out on revenue because he hasn't paid those taxes for almost a year?

Hoskins Lies In Official Statement To Voters About Delinquent Taxes

Hoskins Claims he has been on a "tax installment plan" while knowing no such plan ever existed

JEFFERSON CITY - In a press release sent out from State Rep. Denny Hoskins official office, titled "Hoskins Responds to Criticism Regarding Tax Issue", Hoskins claims "we are not neglecting to pay our property taxes" and that the House Democrats are "making an issue out of our tax installment plan at a time when all Missourians are feeling shockwaves from the economic downturn."

Official records show that on 5 separate attempts to collect from HOS Properties, it clearly states that "partial payments are not accepted by law" because of the delinquent status. In fact, the only partial payments accepted by law in Johnson County are pro-anticipated payments for taxes due in the future, not delinquent taxes. Denny Hoskins still owes $20,317.89 in delinquent taxes.

"Denny Hoskins is now using his official, taxpayer funded state office, to blatantly lie about being on what he calls a "tax installment plan" for his $20,317.89 in delinquent taxes. No such plan exists or is even allowed in Johnson County for delinquent taxes. Denny Hoskins has reached a new low in comparing his problem to other working families. 92 percent of families in Johnson County pay their taxes on time. Denny Hoskins does not. And even worse, he continues to lie about why that is the case," said Chris Moreno, Executive Director of the Missouri House Democratic Campaign Committee.

In a Nov. 11 story in the Warrensburg Daily Star-Journal, Republican state Rep. Denny Hoskins said he hasn't paid more than $20,000 in taxes and penalties because of financial hardships caused by the recession and said he had "no target date" for paying his delinquent taxes. Yet in a statement he issued from his state office on Nov. 12, Hoskins said the "taxes will be paid in full by the end of this week."

"Since the recession hasn't suddenly ended, we are forced to wonder where exactly did Denny Hoskins suddenly get $20,000? If he had the money all along, why did he wait until he was publicly caught to pay up? If he truly was struggling financially as he originally claimed, where did the money come from? Hoskins' lame attempt to explain away his failure to pay his taxes on time like other Missourians raises more questions than it answers," Chris Moreno said.

Update: Hoskins pays off tax bill

....Reached by phone, Hoskins said the company had planned to pay the bills off in a series of payments, but decided today to do it all at once.

Small, the collector, said taxpayers are not permitted in Johnson County to pay "installments" of tax bills, although Hoskins could have paid separately the balances on each of the properties. The bills on the five properties ranged from $500 to $9,637.
